By using the Services and/or requesting a quote for coverage through the Site, you agree to allow us toWe may also obtain information from other sources (updated addresses, credit history, search history, property information, VIN information, etc.) about you, your home and/or automobiles (collectively, "Outside Resources"), and may add it to our own account information and/or may provide it to Carriers in connection with the Services. We are not responsible for any data or information obtained from any such Outside Resources (nor the accuracy or completeness thereof), nor any use of such information by Carriers.
The Site is owned and operated by BOX. We have the right at any time to change or discontinue any aspect or feature of the Site including, without limitation, the contents of the Site and any services offered by the Site. You may visit our Site at any time to read these Terms and learn of any revisions made to these Terms. All such changes are binding on you 14 calendar days after they are initially posted on the Site unless you are a new user, in which case they are binding on you immediately.
2. Intended Use.
The Site is intended for your benefit to become familiar with BOX and to request home and automotive insurance coverage proposals from Carriers (collectively, the “Services”). Moreover, you agree not to submit false or incomplete information via the Site. You understand that BOX does not accept any liability whatsoever for any harm that might result from your use of the Site, including any Carrier services or products referred by us or offered through our Site. You understand that any statements by BOX, its employees, agents, affiliates, and members are provided for informational purposes only. The use of the Site and the Services are intended only for legal residents of the State of Texas who are at least 18 years old.
3. Our Services.
BOX gathers information from you to submit to Carriers for the purpose of obtaining insurance quotations from Carriers on your behalf and for our other business purposes. The Services may include follow up communications between BOX and you and/or between BOX and Carriers on your behalf to facilitate obtaining Carrier proposals and/or your purchase of insurance coverage from a Carrier. BOX does not issue or sell insurance policies, and is not responsible or otherwise liable for any insurance policies or related services provided by Carriers. BOX is an independent insurance broker, and has no shared ownership or corporate affiliation with any Carrier, nor does BOX share common management with any Carrier.
4. Use of Information and Materials on our Site.
The information contained on our Site is subject to change without notice. While BOX makes every effort to ensure that the information on our Site and any quotes received from a Carrier are accurate, BOX makes no representations or warranties as to the accuracy or reliability of any such information. Any unauthorized use of our Site and systems including, but not limited to, unauthorized entry into our system or misuse of any information posted on our Site, is strictly prohibited. Except as expressly granted herein, the viewing, printing, or downloading of any content, graphic, form, or document from the Site is prohibited. BOX grants you only a limited, nonexclusive license for use of such materials solely by you for your own personal use and not for republication, distribution, assignment, sublicense, sale, preparation of derivative works, or other use.
5. Third Party Links/Services
For purpose of delivering the Services, BOX will share information provided by you through the Site with Carriers and other business partners and affiliates of BOX. These Terms apply solely to your use of the Site and the Services, and do not apply to any insurance policies, proposals, or quotations from any Carriers, or any further dealings you may have with Carriers outside of the Site and the Services. All quotes, insurance policies, contracts and communications between you and any Carriers are subject to your agreement with such Carrier, and BOX has no responsibility related thereto. We are not responsible for the content, accuracy, or opinions expressed by any Carrier.
We may also obtain information from other sources (updated addresses, credit history, search history, property information, VIN information, etc.) about you, your home and/or automobiles (collectively, “Outside Resources”), and may add it to our own account information and/or may provide it to Carriers in connection with the Services. We are not responsible for any data or information obtained from any such Outside Resources (nor the accuracy or completeness thereof), nor any use of such information by Carriers.
Limitations of Warranties and Remedies. To the full extent allowed by law, BOX disclaims all warranties, terms, or conditions, express or implied, either in fact or by operation of law, statutory or otherwise, including warranties, terms, or conditions of merchantability, and fitness for a particular purpose. BOX neither assumes nor authorizes any other person to assume for it any other liability in connection with the Services provided by BOX. In no event will BOX be liable for any incidental, consequential, punitive, or special damages, including, without limitation, lost profits or revenues, even if BOX has, or should have had, any knowledge, actual or constructive, of the possibility of such damages.
Indemnification. You agree to defend, indemnify, and hold harmless BOX and its officers, directors, agents and employees (the “BOX Parties”) against any and all claims, suits, costs, losses, liabilities, and expenses of any kind (including reasonable attorneys’ fees) that the BOX Parties may incur arising out of or resulting from your use of the Site or any of the Services of BOX.
Choice of Law and Venue. These Terms will be construed and governed in accordance with the laws of the State of Texas without application of choice-of-law provisions that would require application of the laws of another jurisdiction. By using the Site and/or the Services, you hereby irrevocably submit yourself to the exclusive venue and personal jurisdiction of the state and federal courts in Dallas County, Texas with regard to any dispute relating to the Services or these Terms. You also hereby waive any challenge to venue and personal jurisdiction you may have to a lawsuit filed in a state or federal court in Dallas County, Texas, relating to a dispute between the parties relating to the Services or these Terms.
Severability. If any provision of these Terms are found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of any of the remaining provisions will not in any way be affected or impaired and a valid, legal, and enforceable provision of similar intent and economic impact will be substituted therefore.
Additional Provisions Regarding Liability. You and BOX agree that the foregoing limitations will not be read so as to limit any liability to an extent that would not be permitted under applicable law and specifically will not limit any liability for gross negligence, intentional, tortious, or unlawful conduct or damages for strict liability that may not be limited by law.
Notices. Any notices or communication sent by you to BOX pursuant to these Terms will be in writing and sent to the address specified herein or such other address as BOX may specify in writing. All notices must be sent to: firstname.lastname@example.org
8. Additional Information.
Trademarks. BOX is the owner of the marks, “CHAI,” chai.boxinsurance.com, and all other BOX marks, slogans and logos which appear on the Site. All other marks and logos appearing on the Site are owned by their respective owners. BOX is the owner of all the Site’s trade dress, including, without limitation, the overall look and feel, page headers, design properties, distinctive color combinations, typography, graphic designs, graphical user interfaces, data displays, button icons, and imagery. All rights are reserved.
Copyrights. Our Site contains copyrighted material and other proprietary information, including, without limitation, downloadable files, text, charts, reports, data displays, software, graphical user interfaces, icons, photos, video, and graphics. The contents of the Site are protected under the United States and foreign country copyright laws, as well as international treaties. You may not modify, publish, transmit, display, participate in the transfer or sale, create derivative works, or in any way exploit any of the Site’s content, in whole or in part. No copying, redistribution, retransmission, publication, or commercial exploitation of downloadable material will be permitted without the express written permission of BOX and the copyright owner, if applicable. All rights are reserved.
9. Suggestions and Idea Submissions.
Unless otherwise agreed to in writing, BOX does not accept unauthorized idea submissions outside of established business relationships. To protect the interests of our current partners and ourselves, we must treat the issue of such submissions with great care. Importantly, without a clear business relationship, BOX cannot and does not treat any such submissions in confidence. Accordingly, please do not communicate unauthorized idea submissions with BOX through the Site. Any ideas disclosed to BOX outside of a pre-existing and documented confidential business relationship are not confidential and BOX may therefore develop, use, and freely disclose or publish similar ideas without compensating you or accounting to you. BOX will make every reasonable effort to return or destroy any unauthorized idea submissions without detailed review of them. However, if, in BOX’s sole discretion, BOX determines that a review is necessary, it will be with the understanding that BOX assumes no obligation to protect the confidentiality of your idea or compensate you for its disclosure or use. By submitting an idea or other detailed submission to BOX through the Site, you agree to be bound by the terms of these Terms.
10. Representations and Warranties.
By using the Site, you represent and warrant that you are using the Site solely for personal reasons and that you are not an attorney or an agent of an attorney conducting an investigation to a potential claim related to the Site, any materials available through the Site, or BOX. You also represent and warrant that you are not engaging in activities in an attempt to circumvent, or make any efforts thereto, any encryption, password protection, or security features placed within the Site or any subpart thereof, or reverse engineer any part of the Site, portions of the Site, or any materials available through the Site. You also represent and warrant that any information you provide us is true and accurate.
At Box Insurance (“BOX”), we believe it is important to protect and respect the privacy of our customers and visitors to our website, chai.boxinsurance.com and affiliated sites, forwards and redirect sites (collectively, the “Site”). We are committed to ensuring your privacy as a guest and a customer as set forth below, and we know you care about how your personal information is collected, used, and shared.
General. In general, you can visit the Site without telling us who you are or revealing any personal information about yourself. However, to obtain services via the Site from BOX, we will ask you when we need information that personally identifies you or allows us to contact you (“Personal Information”). Generally, this information is requested when you contact us for information or request that we obtain an insurance quote from third-party insurance carriers (“Carriers”) (collectively, the “Services”).
We use your Personal Information for the following primary purposes:
To facilitate the marketing and delivery of our Services, including, without limitation, obtaining insurance proposals and quotations from Carriers.
To make our Site easier for you to use by not having to enter information more than once.
To help you quickly find information on the Site.
To communicate with you in connection with the Services.
To alert you to special offers, updated information and other services from our company, affiliates, and business partners.
Collected Information. BOX may collect information from you in several different ways including the following:
Form Input. When you supply information to the Site seeking insurance quotation Services, you are required to give certain Personal Information, which includes, without limitation: your name, address, e-mail address, phone number, driver’s license numbers, home and vehicle information, personal financial and/or credit information, and other information to BOX, which will be shared with Carriers and our other affiliates and business partners (collectively, “Third Party Vendor”). We use this information to contact you about obtaining insurance from Carriers. BOX is not liable for the privacy of your information provided to such Third Party Vendors. You must review their privacy and other policies before providing additional information to Third Party Vendors.
Order/Purchases. BOX does not issue and sell policies, and has no responsibility for the rights or obligations provided in any policy you purchase from a Carrier referred to you by us. BOX does not process your payments for any such policies, which will be handled by Carriers or other Third Party Vendors.
Requests. When you request information from us, by phone or e-mail, or otherwise through the Site, or by requesting to join our mailing list, we may collect certain personally identifiable information from you. If you respond to a survey or signup contest or drawing, we may request certain Personal Information. We use this information to provide you with information, customer service, or other services related to your request.
Log Files. As is true of most websites, we gather certain information automatically and store it in log files. This information includes Internet Protocol (IP) addresses, browser type, Internet Service Provider (ISP), referring/exit pages, operating system, date/time stamp, and movements around the site, and to gather demographic information about our user base as a whole. We do not link this automatically-collected data to personally identifiable information.
Correspondence. If you send us correspondence, such as an email or letter, or via a Site form, we may collect such information into a file specific to you.
Third Party Referral. We may collect certain personally identifiable information regarding you when a third party may voluntarily provides such information, such as when using a “Send To A Friend” option with respect to our communications.
Public/Sponsored Events. BOX may participate in public events and events with sponsors, such as trade shows and seminars. These events generally collect certain personally identifiable information from all attendees and distribute this data in whole or in part to all the event sponsors including BOX. While we cannot control and are not responsible for the practices of other sponsors for these events, BOX will maintain the privacy of its copy of your personal information received in this way.
Site Usage. BOX may monitor your activities, preferences, and transactional data (such as your IP address) relating to your use of the Site and/or services and log this information. This information may be used to diagnose Site technical problems. We also use personal and non-personal information in aggregate or statistical form in order to improve our Services, services and procedures. This means that information from many persons and/or web site visits is grouped together in a way that does not disclose the personal information of any particular person. Except as provided herein in connection with the Services, BOX will not disclose to non-affiliated third parties without your prior approval, your e-mail address, phone number, or other Personal Information, that we collect via the Site. However, we reserve the right to outsource certain activities such as mass mailings, order fulfillment, shipping and credit card processing, on a limited basis, to certain third parties. In such cases, we strictly limit the information provided to these third parties to the minimum necessary for them to perform the functions for which we have retained them and prohibit them from using the information for any other purpose or retaining it after it is not longer needed.
Cooperation with Legal Authorities. BOX, however, will cooperate with official law enforcement inquiries, such as fraud investigations, subpoenas, and government inquiries and request, and will disclose your information when necessary to comply with state and federal laws and regulations.
Use Limited to Adults Over the Age of 18. This Site is not for use for anybody under the age of 18. By using this Site, you verify that you are over the age of 18 and in compliance with this provision.
BOX is committed to ensuring that your information, including your Personal Information, is protected while you are on the Site. BOX uses appropriate and reasonable measures to maintain the security of your Personal Information. This includes procedures followed by our personnel to prevent data loss or theft, physical security of our servers and information stores and electronic security such as firewalls, password-protected databases and secure connections. You should be aware that no data transmitted over the Internet, sent through the mail, or stored on a computer is 100% secure and that we cannot guarantee the security of your personal data while in transmission to us. Public computers in particular should never be considered secure. You should never give out personal information on message board, in chat rooms and other publicly-viewable locations. Lastly, if you have been assigned a login ID and/or password for use on a BOX system (for example, a login for our web store to purchase Services), you should never give out that information to others.

Links and use of Outside Resources. The Site may contain links to other sites and/or obtain information from third-party sources (e.g., updated addresses, credit history, search history, property information, VIN information, etc.) about you, other drivers and potential insured persons, your home, and/or automobiles (collectively, "Outside Resources") and may add it to our own account information and/or may provide it to Carriers in connection with the Services
Choice/Opt-Out. You may opt out of any emails/newsletters at any time by using the Opt-Out or Unsubscribe option at the bottom of most of our mass email communications, or by contacting us through the “Contact Us” section of the Site.
Access to Personal Information. If your personally identifiable information changes, or if you no longer desire some or all of our Services, you may correct or update it by contacting us.
Business Transition. In the event we go through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of our assets, your personally identifiable information will likely be among the assets transferred.
